Terms of
Service.

These terms define the custom-song package, payment, revisions, ownership, permitted use and responsibilities of both the customer and ObeyTheAlgorithm Media.

Please read these terms before submitting a request or paying. By checking the agreement box, sending the request and later paying an accepted invoice or checkout, you agree to the version identified in your request record.

1. Parties and eligibility

“ObeyTheAlgorithm,” “we,” “us” and “our” mean ObeyTheAlgorithm Media, a trade name operated by Vacation Vibez Brewing Inc., a New Brunswick corporation. “Customer,” “you” and “your” mean the person purchasing the service. You must be at least 18 years old and legally able to enter a contract.

2. Requests and acceptance

A submitted form is an inquiry, not a confirmed order. We may accept or decline any request before payment. A project begins only after we confirm its scope, delivery estimate and intended use in writing and receive cleared payment. Changes requested after acceptance may change the scope, price or timeline.

3. Standard package

The standard package is $69 USD plus any applicable taxes disclosed before payment. It includes one original custom song based on the accepted brief, generally 2–4 minutes long, with human-written and edited lyrics, a human lead vocal performed by ObeyTheAlgorithm and AI-assisted digital instrumentation, delivered as an MP3. A different duration, file format, rush schedule, alternate version, stems, commercial use or other additional service requires written agreement and may cost more.

We aim to reflect the requested genre, mood and details while retaining reasonable creative judgment. We create an original work and will not promise an exact copy of another song, performer, producer, copyrighted recording, or a living artist’s voice or distinctive style. Reference artists and songs are used only to understand broad genre, mood, era and production preferences.

4. Payment

Full payment is required before creative work begins. Prices are in United States dollars unless stated otherwise. Your card provider may apply currency-conversion or international transaction fees that we do not control. You are responsible for any optional service you separately authorize and any applicable tax disclosed before payment. You must not initiate a chargeback for a good-faith contractual disagreement without first contacting obeythealgorithmai@gmail.com and allowing a reasonable opportunity to resolve it; this does not limit rights that cannot legally be waived.

5. Customer materials and permissions

You grant us a limited permission to use the names, stories, phrases, reference materials and other information you submit only to evaluate, create and administer your project. You confirm that you have the authority and any necessary consent to provide that material. You must not submit content that is unlawful, threatening, defamatory, invasive of privacy, infringing, deceptive or intended to impersonate or harm another person.

You are responsible for reviewing spelling, names, dates, facts and pronunciations. We may refuse or stop work on prohibited material.

6. Timing and customer delays

The standard target is 14–21 calendar days after cleared payment and receipt of all required information. This is an estimate unless a firm date is explicitly accepted in writing. Late answers, incomplete details, changed instructions or delayed revision feedback extend the timeline. Rush work requires separate written approval and pricing.

7. Listening copy and revisions

A private, watermarked or otherwise review-only listening copy may be provided during the project. Review copies are not final deliverables and may not be downloaded, distributed, published, monetized or commercially used unless we expressly authorize it.

The standard package includes one consolidated revision round covering up to three minor lyric changes. A minor lyric change is a limited wording correction, replacement or addition that does not materially change the accepted story, concept, structure, melody, genre, mood or vocal direction. The complete revision list must be submitted together within seven calendar days after the first listening copy is delivered. Unused revisions have no cash value.

Each additional consolidated revision round costs $25 USD and must be paid before that work begins. New information, a new subject, story, genre, concept, structure, melody, vocal direction or substantial rewrite is new scope and requires a separate quote. If we misstate a name, fact or detail that you supplied correctly in the accepted brief, we will correct that error without charge and it will not use the included revision round.

8. Approval and delivery

You are responsible for listening and identifying requested corrections within the seven-day revision window. The project is considered accepted and complete when you approve it, request final delivery, or do not submit an eligible revision request within seven calendar days after delivery of the applicable listening copy. The final MP3 will then be delivered using the method confirmed by email. We may retain reasonable archival copies but do not guarantee indefinite storage or replacement downloads.

9. Copyright and licence

You retain ownership of the original stories, photographs, recordings, lyrics or other material you owned before submitting them. Unless a separate written agreement expressly says otherwise, ObeyTheAlgorithm Media retains all copyright and related ownership in the newly created composition, lyrics, arrangement, performance and sound recording.

After full payment, you receive a non-exclusive, worldwide, perpetual licence to listen to and use the final song for personal, non-commercial purposes. This includes private sharing with friends and family, playing it at a personal wedding or family event, and posting it to a personal non-monetized social-media account with credit to ObeyTheAlgorithm.

You may not sell, sublicense, distribute it through Spotify, Apple Music or another streaming service, use it in monetized video, commercially release, advertise with, register it with a copyright office, performing-rights organization or distributor, claim authorship of it, create merchandise from it or otherwise commercially exploit it without a separate written commercial licence or rights assignment. No copyright assignment or waiver of moral rights is made by the standard package.

10. Confidentiality and portfolio use

We will not intentionally publish your personalized song or private story as a public portfolio example without your permission. Information may still be used as needed to provide the service, process payment, maintain records, comply with law and resolve disputes, as described in our Privacy Policy.

11. Refunds and cancellation

The Refund Policy forms part of these terms. In summary, you may receive a full refund if you cancel before creative work begins. Once creative work begins, payment is generally non-refundable because the service is personalized. If the delivery materially fails an objective part of the accepted brief, our first remedy is correction or revision. A refund is available if we cancel without providing the agreed service, fail to deliver after a reasonable extended deadline, cannot correct a material failure, process a duplicate payment, or applicable law requires it.

12. No guaranteed reaction or result

Music is subjective. We do not guarantee that the song will produce a particular emotional response, match an imagined result exactly, achieve streams, sales, publicity or approval from any third party. Dissatisfaction based only on taste after performance of the accepted brief is not a failure to provide the service.

13. Liability and indemnity

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or lost-profit damages arising from the service. Our total liability relating to a project will not exceed the amount you paid for that project. Nothing in these terms excludes liability or consumer rights that cannot legally be excluded.

You agree to be responsible for claims caused by material you supplied, your lack of permission to supply it, or your unauthorized use of the song. This responsibility does not apply to the extent a claim was caused by our own unlawful conduct.

14. Events outside reasonable control

Neither side is responsible for delay caused by events reasonably outside its control, including serious illness, service outages, disasters or government action. We will communicate material delays and propose a reasonable revised timeline or remedy.

15. Governing law and disputes

These terms are governed by the laws of New Brunswick and the federal laws of Canada applicable there, without removing mandatory consumer rights that apply where you live. Before starting formal proceedings, both sides agree to attempt in good faith to resolve a dispute by email for at least 30 days. Subject to mandatory law, disputes may be brought in the courts of New Brunswick.

16. General terms

If part of these terms is unenforceable, the remaining parts continue. Failure to enforce a term once is not a waiver. These terms, the accepted brief, written project confirmation, Refund Policy and Privacy Policy form the agreement. Project-specific written terms control if they expressly conflict with this page. Material changes apply prospectively and will be identified by a new version date.
